The following General Terms and Conditions govern the purchase of products made remotely via telematic network on the website www.pebeautytech.com in the E-commerce section owned by IKON S.r.l.s.
These purchases are reserved for direct users, merchants, wholesalers, resellers, and professionals.
Each purchase operation will be regulated by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; the information leading to the conclusion of the contract will be subject to Article 12 of Legislative Decree 70/03 and, regarding privacy protection, will comply with the regulations of Legislative Decree 196/03.
In accordance with the new guidelines of the Ministry of Health dated 28/03/2013 regarding healthcare advertising for medical devices, in-vitro diagnostic devices, medical-surgical devices, and electromechanical equipment, it is specified that the content used on the website (texts, images, photos, drawings, attachments, etc.) related to these products does not have the character or nature of healthcare advertising.
All content should be understood and is of an exclusively informative nature, aimed only at making professionals aware of the general features of the products sold online on the pebeautytech.com website, which disclaims any responsibility for any discrepancies in illustrative images due to variations made by manufacturers.
These general conditions are effective from the date of acceptance by the customer on the website, which is considered as acceptance under Article 1341 of the Civil Code.
IKON S.r.l.s. reserves the right to modify these general sales conditions at any time by posting them on the website.

ORDER DEFINITION
Sales Services:
By submitting an online order, the Customer sends a proposal to pebeautytech.com to purchase the product(s) added to the cart. When the Customer places an online order for the products they have added to the cart, they agree to purchase them at the price and terms specified in these General Terms and Conditions of Sale.
pebeautytech.com will notify the Customer of the acceptance and confirmation of the order.
Orders will not be accepted if:
- The delivery address is not in Europe;
- The Customer cannot or does not wish to accept the available Payment Methods;
- The Customer does not register on the website.
- Orders can only be placed via the website www.pebeautytech.com at the prices and conditions indicated on the site.
CONDITIONS FOR THE CUSTOMER
The customer must read and accept the general terms and conditions of sale before submitting the order.
The customer is committed to printing and saving the various stages of the purchasing procedure, thus confirming the procedure, in order to fully satisfy the conditions of Articles 3 and 4 of Legislative Decree 185/1999 and Article 12, paragraph 3 of Legislative Decree 70/03.
PRICES
The prices indicated are in euros, including VAT, and may change without notice from pebeautytech.com.
The price indicated for the products does not include delivery charges.
DELIVERY TIMES
Orders will be processed on the same day and delivered within 24/48 hours, depending on warehouse availability.
If not available, pebeautytech.com will ship products in separate shipments, and subsequent shipments will be at no cost to the customer.
INCORRECT OR DEFECTIVE PRODUCTS
The return of such goods must be authorized by pebeautytech.com and must occur within 8 days from receipt of the goods. Products will be replaced without any charge, with shipping at no cost using our couriers.
DELIVERY CONDITIONS
If the customer decides to delay the delivery or refuses the delivered goods, a 30 euro fee for opening the practice and shipping charges will be charged by pebeautytech.com.
Customers should be aware that if the courier does not find anyone at the delivery address during the first attempt, they will leave a notice informing the customer that a re-delivery will be attempted the following day without additional charges.
INSURANCE
Although the goods travel at the buyer’s risk, all shipments are covered by insurance, with a fee of 1.00 €/kg.
It is strongly recommended that goods of higher value be shipped with insurance valued at 4.00 €, available in the “Cart” section, providing coverage up to 1500€. The company advises insuring, at the cost of 4.00 €, all products marked "FRAGILE!" in the main description.
Upon arrival, the customer should check for external damage or tampering. If there is any damage, the customer must accept the goods with “Reservation of Inspection.” Only then will the insurance company recognize the damage or potential shortage.
Always communicate any disputes in writing. If the goods are not insured, they will travel under the customer's responsibility, and the company will be exempt from any responsibility if the goods arrive damaged.
WARRANTY
The warranty covers only manufacturing defects and does not apply to products that are tampered with, repaired by third parties, or used improperly.
OFFERS
The conditions of each product's offer are those listed and visible in the online catalog during the order process before the conclusion of the contract. Except for ongoing orders, pebeautytech.com reserves the right to update any offer conditions at any time and without prior notice.
ASSISTANCE
Products sold through the site are covered by a Commercial Warranty or (OUT-SIDE) responsibility of the product's manufacturer, where pebeautytech.com will assist the customer in obtaining the necessary support as promptly as possible.
The customer will be informed of any product purchased, including phone numbers for assistance and the warranty period offered by the manufacturer for each brand and model.

It is necessary for the customer to provide a copy of the invoice and delivery document that confirms the delivery date along with the delivered product.
All operations are protected by Legislative Decree 2 February 2002, No. 24.
RIGHT OF WITHDRAWAL
According to Article 5 of Legislative Decree 185/1999, if the customer is a consumer (i.e., an individual purchasing goods for non-professional purposes or not providing a VAT number in the order form), they have the right to withdraw from the purchase contract for any reason, without the need for explanations and without any penalty.
The right of withdrawal is regulated by the current regulations on "e-commerce" and is granted by pebeautytech.com to end users within 14 working days from the delivery date.
To exercise the right of withdrawal, the end user must initially contact via email at ordini@ikonsrls.it and follow the instructions provided. The withdrawal notice must then be sent by registered letter with acknowledgment of receipt to IKON S.r.l.s VIA ENRICO MATTEI 13/19 60027 OSIMO (AN) ITALY or via email at ikonsrls@pec.it.
Pebeautytech.com will reimburse the customer for the cost of the good, which must be returned with shipping costs borne by the customer, after checking the condition of the product.
The good must be returned to pebeautytech.com intact, in its original, unopened and undamaged packaging, including any documentation and accessories: manuals, cables, etc.; if any of these factors is missing, the amount already paid cannot be refunded.
The shipment, until confirmation of receipt in our warehouse, is fully the customer's responsibility. In the case of damage during transport, pebeautytech.com will notify the customer (within the next working day after receiving the goods in our warehouse) to allow them to file a claim with the carrier and obtain a refund of the product’s value (if insured); in this case, the product will be returned at the customer's expense, simultaneously canceling the withdrawal request.
Pebeautytech.com is not responsible for damage or theft/loss of goods returned with uninsured shipments.
The customer must provide the necessary bank details for the reimbursement (IBAN - Bank account of the invoice holder).
If the right of withdrawal is forfeited, pebeautytech.com will return the purchased goods to the sender, charging them for the shipping costs.
COMPLAINTS
For any complaints or clarifications, the customer must contact the email address ordini@ikonsrls.it.
The customer will be contacted for clarification within five (5) working days from the request.
IKON reserves the right to offer the customer a voucher for purchases, which must be used within three (3) months of receipt, in case of a complaint or if the customer exercises the right of withdrawal.
JURISDICTION AND COMPETENT COURT
The sales contract between the Customer and pebeautytech.com is concluded in Italy and governed by Italian law.
For any dispute related to the validity, interpretation, or execution of the contract, the territorial jurisdiction is that of the court in the location of the seller's legal or tax residence.
LEGAL NOTES
Since the website is accessible from all countries around the world, and each country has its own laws which may differ from Italian laws, by accessing this website, users agree that Italian laws and regulations will apply to any issues related to the use of this site.
For any dispute that may arise, the court of Ancona is designated as the competent forum.
Pebeautytech.com is not responsible for any damage caused by improper use of the products sold through this site.
It is also not responsible for manufacturing defects, for which the manufacturers themselves are solely responsible.
Shipping costs listed on the invoice represent the expenses incurred on behalf of the customer. They are documented and excluded from the taxable base under Article 15, paragraph 1, no. 3 of Presidential Decree 633/72.
All trademarks on the site are registered; unauthorized use of them will be prosecuted according to the law.
Users are advised that the site may contain images that could offend the modesty of certain ethnic groups or contradict certain religious beliefs. Therefore, access to such materials is expressly prohibited from territories where such content is illegal.
Those who choose to access this site from other countries do so at their own risk and will be solely responsible for compliance with the relevant local laws.

DAMAGE LIABILITY NOTES
Who is responsible if the goods arrive damaged?
The responsibility for loss or damage to goods during transportation lies with the carrier, from the moment they take the goods from the seller until the moment they are delivered to the buyer.
What is the value of the refund?
The final consumer who purchases a product that is broken or non-functional can take action against the carrier, but the carrier is only required to refund the value of €1 per KG of weight, unless the consumer can prove the carrier's fault (in which case legal action is necessary, unless the product is insured). The consumer can take action against the seller only if the product is broken or non-functional due to original defects that did not occur during transport.
Why sign "WITH RESERVATION"?
It is always advisable for the consumer who purchases the goods, when receiving a package they suspect might contain a broken product (perhaps because the packaging is already damaged or does not feature the company’s tape), to sign the delivery slip “WITH RESERVATION,” reserving the right to check the product’s integrity later. If they do not do this, they lose any right to claim damage from the seller and can only claim from the carrier.
IMPORTANT!
If the consumer has signed with reservation, they must report the damage to the seller within 8 days. The seller is responsible for managing the compensation claim against the carrier, who remains liable. In the meantime, the seller should replace the product for the consumer. However, if the consumer accepted the goods from the carrier without signing the RESERVATION, in case of damage discovered later, they cannot request the seller to replace the item but can only claim damages from the carrier.
